Kayak Australis Limitations and Responsibilities
Kayak Australis will do everything possible to ensure that
the trip is safe and pleasant. Nevertheless, unpredictable
events, out of the control of Kayak Australis may occur,
in which case, Kayak Australis and its associates do not
assume any responsibility for time or costs incurred due
to illnesses or personal injuries, and/or damage or loss
of equipment.

Kayak Australis also will not be held responsible for problems
with airlines or flight schedules, and in which case we will
assume that the client has canceled the trip if he/she does
not arrive to the meeting place. We also will not assume
any responsibility for delays out of our control.
Kayak Australis reserves the right to postpone or cancel
any trip before the departure due to acts of nature or people.
Kayak Australis does not provide insurance for the participants.
We recommend that participants continue their health insurance
during their stay in Chile. Also, participants should obtain
a short term travel insurance policy in the Country of origin,
to cover both themselves and their equipment.
Important
The excursion schedules may suffer modifications due to
the weather or unforeseen events.
Any additional cost is the responsibility of the participant.
Each participant is responsible for the equipment that Kayak
Australis supplies and is obligated to assume responsibility
for any loss or damage.
Kayak Australis is not obligated, in the case of loss or
damage to personal equipment, to reimburse.
Kayak Australis will not be responsible for accidents or
injuries of the participants. The participant declares and
assumes the potential risk of the activity to be done.
In the case of an accident, injury or illness of the participant,
the medical and rescue costs will be paid by the participant.
If the trip must end before planned or modified due to the
climate or for a decision made by the guide because a situation
implies a risk to the group or one of the participants, this
situation will not imply any type of reimbursement.
Our sea kayaking trips are often done in isolated or remote
areas. If during the trip, one of the participants requires
medical assistance, the complete group will evacuate, with
the costs incurred for this evacuation being absorbed by
the affected participant. This situation does not imply reimbursements
for any of the participants. The possibility may be considered
to offer the same trip on a different date depending on the
availability of the company, at a lesser cost.
Any expenditure not included in this program must be canceled
directly by the participants.
The guide has the right to disqualify any person, at any
time during the trip if they are considered physically incapable
and/or is unhealthy for themselves or the group. In these
circumstances, there will be no reimbursements.
The Responsibilities of the Participants
The trip participants are responsible for understanding
the conditions described in the trip itinerary and for selecting
a trip that is appropriate for their interests and capabilities
and also for questioning suggestions of the company if there
is a disagreement.
The participants are responsible for: 1) bringing clothing
and appropriate equipment according to the advice in the
equipment list, given by Kayak Australis; 2) maintain a standard
norm of personal hygiene; 3) diminishing the risk of traveler’s
illnesses; 4) follow a standard norm of social behavior with
other participants on the trip, and 5) respect the customs
of the visited areas.
The participant must cooperate and obey the guide’s
instructions, avoid adventurous situations and respect the
rules established by Kayak Australis.
It is the participant’s responsibility to read the
programs, the trip conditions, and understand the characteristics
of each expedition.
The participants assume all potential risks, injuries and
medical expenses from any accident or illness, including
death.
The trip participants are responsible for their own medication.
Kayak Australis is not responsible for the medications that
a participant needs.
It will be the participant’s responsibility to complete
and send the “Medical Form” that allows them
to safely do the trip. People over 60 years must present
medical certification that their state of health is in accordance
with the activity to be done, considering the difficulty
or impossibility to reach primary medical attention.
Program Cancellation or Suspension by Kayak Australis
The trip will be suspended or cancelled if there are situations
out of the control of our company, this does not imply any
refunds or payments. These situations may be: weather problems,
safety risks to the participants, schedule changes, measures
or rules in the areas we visit, etc.
Reservations
The trip cost must be completely cancelled before the departure
date.
Methods of Payment
Bank withdrawal (money or wire transfer through Western
Union or Chilexpress). Deposit or Payment Order in our bank
account at Banco de Chile.
Online credit card payment through our web site.
For trips more than 3 days.
The reservation must be done at least 4 months in advance.
After receiving your reservation request, through email or
fax, Kayak Australis will keep the reservation for a maximum
of two months, in which time the person interested must confirm
the reservation with a deposit of US$350 per person.
Once this deposit is received by Kayak Australis, we will
send immediate confirmation of the reservation. Together
with this, we will send our Medical and Letter of Exemption
from Responsibilities forms.
The remaining amount of the cost for the trip must be paid
at least 45 days before the departure date, if not, Kayak
Australis reserves the right to consider your reservation
cancelled (see Cancellations and Suspensions). If the payment
is made within 45 days before the departure, there will be
an additional cost of US $100.
Late
Reservations
If there is space available on one of our trips, it will
be possible to make a reservation as long as it is done no
less than 30 days before the departure. In this case, there
will be a surcharge of US$100 on the total cost of the trip.
Cost of the Trip
The cost of the trip may be modified in the following situations:
In case there are only 2 people who have contracted a trip,
there will be an additional cost to avoid cancellation.
We will also adjust the costs in such cases that there are
exceptional increases in the costs out side the control of
Kayak Australis.
Cancellations and Reimbursements
The following is a general scale of the costs for cancellations
per participant before the trip departure date:

Photography
During the trip Kayak Australis reserves the right to take
photos, or videos during the operation of any trip or of
part of it, and to use these for promotional purposes. Through
the reservation with Kayak Australis, the trip participants
agree to allow their picture to appear in promotions.

- Equipment and travel insurance
- Airport taxes
- Trip cancellation insurance
- Sleeping bag and mattress
- Food in cities and towns (depending
on the program)
- Excess
baggage fees
- Medication, laundry, or personal items
- Any additional cost
because of changes in the schedule or itinerary that are
not the fault of Kayak Australis.
- Costs
of medication, prescriptions, hospitalizations, transfers
not specified in the contracted program, any type of evacuation
(air-water-land) and any other cost not specified in the
program.
